Ensuring Product Safety Across the European Market: Understanding the General Product Safety Regulation (EU 2023/988)
The General Product Safety Regulation (EU 2023/988), adopted on March 30, 2023, aims to enhance consumer safety across Europe. Effective from December 13, 2024, this regulation introduces stringent requirements for all parties in the product supply chain, including manufacturers, authorized representatives, importers, distributors, and fulfilment service providers.
The regulation mandates that only safe products may be placed on or offered within the EU market. Safety is defined not only in terms of design and function but also through compliance with traceability requirements, clear usage instructions, and the inclusion of contact details for the manufacturer and importer.
These obligations extend to online and offline sales, covering all products intended for consumer use, including second-hand and pre-owned items.
Ensuring Compliance with Safety Standards
Products deemed safe by accredited organizations, such as those tested by the RDW and certified with an E-mark or compliance with UN/ECE Regulation No. 124, meet the requirements of Article 5. Such products are considered safe unless altered post-certification.
